1. Acceptance of Terms

By accessing or using JobApply ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

JobApply is a job application management platform that provides AI-powered tools for tracking applications, generating documents, and automating parts of the job application process. The Service uses artificial intelligence to assist with form-filling, document creation, and application submission.

3. Account Registration

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Subscription Plans and Billing

• Free accounts have limited usage as described on our pricing page.
• Paid subscriptions are billed monthly. Prices are in Canadian Dollars (CAD) and subject to applicable taxes (HST).
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• Refunds are handled on a case-by-case basis within 14 days of purchase.

5. AI-Generated Content

• The Service uses AI to generate resumes, cover letters, and application responses. You are responsible for reviewing all AI-generated content before submission.
• AI-generated content may contain errors. We do not guarantee accuracy, completeness, or suitability of any generated content.
• You represent that all information you provide to the Service is truthful. The system uses your information to fill applications on your behalf — providing false information may have legal consequences.

6. Auto-Apply Feature

• The auto-apply feature submits job applications on your behalf to third-party websites. You authorize the Service to act on your behalf when using this feature.
• You are responsible for ensuring your credentials and information are accurate.
• We cannot guarantee that automated applications will be accepted by third-party systems.
• Some employers may have policies against automated applications. Use this feature at your own discretion.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We process your personal data in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA).

8. Prohibited Uses

You may not use the Service to: submit fraudulent applications, impersonate others, circumvent employer application systems maliciously, scrape or harvest data from third-party sites beyond what is needed for your own applications, or violate any applicable law.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBAPPLY AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance.
